1. Acceptance of Terms & Modifications
By accessing or using this No-Code Machine Learning Platform ("the Service"), registering an account, invoking API endpoints, uploading datasets, or purchasing compute credits/subscriptions, you ("User" or "you") expressly agree to be bound by these Terms & Conditions. If you do not agree to these terms in their entirety, you must immediately cease all access and use of the Service. We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Service following any updates constitutes acceptance of the modified Terms.
2. Machine Learning Output & Disclaimer of Warranties
The Service provides automated machine learning model training, hyperparameter optimization, model binary generation (.joblib), and automated prediction endpoints. Machine learning is inherently probabilistic and reliant upon input data quality.
- NO GUARANTEE OF ACCURACY: ALL SERVICES, PREDICTIONS, PERFORMANCE METRICS, ACCURACY SCORES, AND EXPORTED MODELS ARE PROVIDED STRICTLY "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- NO PROFESSIONAL RELIANCE: Model predictions generated by the Service do not constitute professional, financial, medical, legal, structural, or risk-management advice. You assume 100% responsibility and liability for evaluating, deploying, and relying upon outputs generated by models trained through the Service.
- PRODUCTION DEPLOYMENT RISK: If you export model binaries or query live prediction APIs in a production environment, you accept full liability for any automated decisions, systemic failures, financial losses, or statistical anomalies resulting from such integration.
3. User Data Warranties & Intellectual Property
- Ownership: You retain exclusive ownership of all raw datasets (CSV, XLSX) uploaded to the Service and any model binaries (
.joblib) generated exclusively from your datasets.
- Platform Intellectual Property: We retain all right, title, and interest in and to the platform, proprietary pipeline code, underlying API architecture, CSS/JS user interfaces, brand assets, and algorithmic workflows.
- Strict Data Prohibitions: You explicitly warrant that uploaded datasets contain no Sensitive Personally Identifiable Information (PII), Protected Health Information (PHI) under HIPAA, payment card industry (PCI) data, government IDs, or legally classified information.
- Legal Authorization & Right to Process: You warrant that you own or possess all required licenses, permissions, and consents to process and upload the data. We explicitly disclaim all liability for monitoring, auditing, or verifying dataset contents uploaded by users.
4. Payments, Credits, Subscriptions & Strict No-Refund Policy
- Instant Compute Resource Consumption: Model training and prediction pipelines consume real-time cloud server resources (CPU/RAM/Storage) immediately upon invocation. Consequently, all payment transactions—including credit pack top-ups and monthly subscriptions processed via Paystack—are FINAL, NON-REFUNDABLE, AND NON-TRANSFERABLE.
- No Refunds for Unused Credits or Partial Terms: Unused credits will not be refunded or converted back into fiat currency under any circumstances. Subscription cancellations stop future billing cycles but do not entitle the user to a pro-rated refund for remaining time in the active cycle.
- Chargeback Defense & Account Termination: Attempting to initiate fraudulent chargebacks, payment disputes, or payment reversals through your bank or Paystack will result in immediate permanent account termination, forfeiture of remaining credits, and submission of server logs to fraud prevention authorities.
5. Prohibited Activities & Account Termination
You agree not to engage in any of the following prohibited behaviors:
- Attempting to reverse-engineer, decompile, or extract source code from the backend platform or underlying API endpoints.
- Executing Denial-of-Service (DoS) attacks, brute-force requests, or overloading computing infrastructure.
- Uploading malicious payloads, embedded scripts, or corrupted CSV files designed to breach backend sandbox environments.
- Using the Service to train machine learning models for illegal, discriminatory, fraudulent, or harmful purposes.
We reserve the absolute right to suspend or terminate accounts immediately without prior notice or financial liability if a breach of these Terms is detected.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS FOUNDERS, OPERATORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, LOSS OF BUSINESS OPPORTUNITY, SYSTEM DOWN-TIME, OR ACCURACY ERRORS.
IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE SHALL BE STRICTLY CAPPED AT AND LIMITED TO THE EXACT AMOUNT PAID BY YOU TO THE PLATFORM IN THE THIRTY (30) CALENDAR DAYS IMMEDIATELY PRECEDING THE CLAIM, OR ₦10,000 NGN, WHICHEVER IS LOWER.
7. Indemnification
You agree to defend, indemnify, and hold harmless the Service, its operators, and developers against any third-party claims, lawsuits, liabilities, penalties, legal fees, or financial demands arising from: (a) your breach of these Terms; (b) datasets uploaded by you; (c) third-party reliance on predictions produced by your models; or (d) your violation of applicable data privacy laws.
8. Service Uptime & Modifications
While we aim to maintain high availability, we do not guarantee uninterrupted 100% uptime. Infrastructure maintenance, cloud backend upgrades (including Render or Supabase outages), or third-party API issues may cause temporary service interruptions. We reserve the right to alter, modify, or discontinue features of the Service at our sole discretion without liability.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable legal frameworks governing digital software services, without giving effect to conflict-of-law principles. Any disputes arising hereunder shall be subject to amicable resolution prior to formal legal proceedings.
